  12. Article 101:  Establishment of the Free Trade Area
  13.  
  14.      The Parties to this Agreement, consistent with Article XXIV
  15. of the General Agreement on Tariffs and Trade, hereby establish a
  16. free trade area.
  17.

  19. Article 102:  Objectives
  20.  
  21. 1.   The objectives of this Agreement, as elaborated more
  22. specifically through its principles and rules, including national
  23. treatment, most-favored-nation treatment and transparency are to:
  24.  
  25.      (a) eliminate barriers to trade in, and facilitate the
  26.  cross border movement of, goods and services between
  27.  the territories of the Parties;
  28.  
  29.      (b) promote conditions of fair competition in the free
  30.  trade area;
  31.  
  32.      (c) increase substantially investment opportunities in
  33.  their territories;
  34.  
  35.      (d) provide adequate and effective protection and
  36.  enforcement of intellectual property rights in each
  37.  Party's territory;
  38.  
  39.      (e) create effective procedures for the implementation and
  40.  application of this Agreement, and for its joint
  41.  administration and the resolution of disputes; and
  42.  
  43.      (f) establish a framework for further trilateral, regional
  44.  and multilateral cooperation to expand and enhance the
  45.  benefits of this Agreement.
  46.  
  47. 2.   The Parties shall interpret and apply the provisions of this
  48. Agreement in the light of its objectives set out in paragraph 1
  49. and in accordance with applicable rules of international law.

  52. Article 103:  Relation to Other Agreements
  53.  
  54. 1.   The Parties affirm their existing rights and obligations
  55. with respect to each other under the General Agreement on Tariffs
  56. and Trade and other agreements to which such Parties are party.
  57.  
  58. 2.   In the event of any inconsistency between the provisions of
  59. this Agreement and such other agreements, the provisions of this
  60. Agreement shall prevail to the extent of the inconsistency,
  61. except as otherwise provided in this Agreement.

  64. Article 104:  Relation to Environmental and Conservation
  65. Agreements
  66.  
  67. 1.   In the event of any inconsistency between this Agreement and
  68. the specific trade obligations set out in:
  69.  
  70.      (a) Convention on the International Trade in Endangered
  71.  Species of Wild Fauna and Flora, done at Washington,
  72.  March 3, 1973;
  73.  
  74.      (b) the Montreal Protocol on Substances that Deplete the
  75.  Ozone Layer, done at Montreal, September 16, 1987, as
  76.  amended June 29, 1990; 
  77.  
  78.      (c) Basel Convention on the Control of Transboundary
  79.  Movements of Hazardous Wastes and Their Disposal, done
  80.  at Basel, March 22, 1989, upon its entry into force for
  81.  Canada, Mexico and the United States; or 
  82.  
  83.      (d) the agreements set out in Annex 104.1,
  84.  
  85. such obligations shall prevail to the extent of the
  86. inconsistency, provided that where a Party has a choice among
  87. equally effective and reasonably available means of complying
  88. with such obligations, the Party chooses the alternative that is
  89. the least inconsistent with the other provisions of this
  90. Agreement.

  92. 2.   The Parties may agree in writing to modify Annex 104.1 to
  93. include any amendment to the agreements listed in paragraph 1,
  94. and any other environmental or conservation agreement.

  96.  
  97. Article 105:  Extent of Obligations
  98.  
  99.      The Parties shall ensure that all necessary measures are
  100. taken in order to give effect to the provisions of this
  101. Agreement, including their observance, except as otherwise
  102. provided in this Agreement, by state and provincial governments.

  108.        Bilateral and Other Environmental and Conservation Agreements
  109.  
  110.  
  111. 1.   The Agreement Between the Government of Canada and the
  112. Government of the United States of America Concerning the
  113. Transboundary Movement of Hazardous Waste, signed at Ottawa,
  114. October 28, 1986.
  115.  
  116. 2.   The Agreement between the United States of America and the
  117. United Mexican States on Cooperation for the Protection and
  118. Improvement of the Environment in the Border Area, signed at
  119. La Paz, Baja California Sur, August 14, 1983.
